I. NEW LICENSE/PERMIT

A. Student Permit for Filipinos

Qualifications:
1. Must be at least sixteen (16) years old.
2. Must be physically and mentally fit to operate a motor vehicle.
3. Must be able to read and write in Filipino or English.

Requirements:

1. Original with photocopy of birth certificate.
In the absence thereof, any of the following:
a. Joint affidavit of two (2) disinterested persons who know the applicant and who can attest to his/her age and identity accompanied by non-availability of record from NSO or local civil registry office.
b. Any legal document to prove his age and identity such as GSIS, SSS, Passport or any government issued identification card.
2. For applicants below 18 years old, require parent’s or guardian’s written consent with photo copy of ID Card to prove his/her identity. If not accompanied by parent/guardian, the written consent must be duly notarized.
3. Taxpayer’s Identification Number (TIN) if employed

B. Student Permit for Foreigners

Qualifications:

1. Must be at least sixteen (16) years old.
2. Must know how to read and write in English or Filipino.
3. Must have arrived in the Philippines for at least one (1) month prior to the date of application with LTO and can show evidence from BID/DFA that he will stay in the country for at least five (5) months from the date of application.

Requirements:

1. Original and photocopy of passport with visa duration of at least five (5) months from date of application and any of the following:
a. Valid Alien Certificate of Registration (ACR).
b. If born in the Philippines, original and photocopy of birth certificate.
c. If student, original and photocopy of school ID.
2. For applicant below 18 years old, require parent’s or guardian’s written consent with photocopy of ID card to prove his/her identity. If not accompanied by parent/guardian, the written consent must be duly notarized.

5. Must be clean, neat and presentable (wearing of sando, playing shorts and slippers during photo-taking and examinations will not be allowed).

Requirements:

3. Medical Certificate with Official Receipt (from LTO accredited or Government physician)

E. Renewal of Driver’s License of Filipinos living abroad

Requirements:

1. Photocopies of Passport (first page, visa page & departure in the Philippines and last arrival overseas)
2. Letter of authority to authorized representative
3. Photocopy of driver’s license and Driver’s License Receipt (DLR), if available

The driver’s license shall be validated by issuing a driver’s license receipt (DLR) which will serve as temporary driver’s license (TDL)
The Licensee shall present himself/herself within thirty (30) days upon arrival to the same Office where the renewal was made for photo-taking and submit the following:

i. Driver’s License

ii. Drug Test Result

iii. Medical Certificate

iv. Photocopy of Passport

IX. PENALTY FOR UNDERAGE DRIVERS

1. A licensed driver found to have misrepresented his age but now of age and qualified to possess a driver’s license shall be required to surrender his previously issued license for cancellation. However the same shall be restored to the licensee upon submission of a written appeal and payment of fine of Five Thousand Pesos (Php 5,000.00) plus miscellaneous fee for revision of records.

1.1 The head of the District office / Licensing center shall forward to the License section, Central office the written appeal together with the official receipt of payment if the misrepresentation was discovered and the licensee was cancelled by the Central Office.

1.2 The License Section upon receipt of the written appeal and Official Receipt shall restore the cancelled driver’s license, by adjusting the first year of issuance of the driver’s license to make it appear that the applicant was at least (18) years old when first issued a drivers license.

1.3 If the misrepresentation was discovered at the agency level, the District Office / Licensing center shall collect the corresponding fees and shall prepare and forward Request for Systems Update (RSU), written appeal, Official Receipt (OR) of P5,000.00 to the License section, Central Office to adjust the first year of issuance of the license.

1.4 The license Section shall inform the requesting agency of the restored driver’s license for release to the licensee.

2. If the Licensee opts for the one year cancellation of his/her driver’s license, he/she must surrender the Temporary Driver’s License to the head of the Licensing Center/District office and shall be barred from applying for a new driver’s license for a period of one year reckoned from the time the Driver’s license/Temporary Driver’s license was surrendered

2.1 The head of the District office/Licensing Center shall confiscate the Driver’s License/Temporary Driver’s license, prepares RSU informing License section, central Office of the confiscated license and forward the physical documents to the License section, Central Office within fifteen (15) days from the confiscation thereof.

2.2 The License section shall place under alarm the cancelled driver’s license and the suspension shall be reckoned from the date confiscation was effected in the District Office/Licensing center or from the time License section received the surrendered Driver’s License/Temporary Driver’s License in case where the District Office/Licensing Center failed to comply with 2.1 hereof.

2.3 The licensee shall be allowed to apply for a Student Permit one year after cancellation of his/her driver’s license.

2.4 A licensee undergoing the one year cancellation period of his/her driver’s license has also the option to pay the fine of Five Thousand Pesos (P5,000.00) for the immediate restoration of the license following the procedure for option 1.

3. This shall also apply to the following:

3.1 Driver licensee who voluntarily requests for correction of record due to age misrepresentation; and

3.2 Driver licensee whose license was cancelled due to underage prior to the promulgation of circular no. AHS-2008-1072

4. This shall not apply to driver licensee found to be under age based on the year of issuance without misrepresentation of birthdate. The License Section upon receipt of the written appeal and Official Receipt shall restore the cancelled driver’s license, by adjusting the first year of issuance of the driver’s license to make it appear that the applicant was at least eighteen (18) years old when first issued a driver’s license.

It is the responsibility of the Transportation District officer to ascertain that documents submitted in support of an application for a driver’s license contain complete and accurate information as to age and identity of the applicant.

Chapter III, Sec. 21 of the Republic Act (RA) 4136, otherwise known as the “Land Transportation and Traffic Code” states that:. “Bonafide tourists and similar transients who are duly licensed to operate motor vehicles in their respective countries may be allowed to operate during but not after (90) days of their sojourn in the Philippines.” Nothing in this article shall be construed to prohibit the licensee for an option to convert valid foreign driver’s license to Philippine driver’s license within the period of ninety (90) days from the date of his last arrival in the Philippines. However, if the foreign driver’s license is not written in English, such driver’s license should always be accompanied by an Official English translation issued by the Local Embassy of the issuing country.

Memorandum Circular (MC) No. 495-2004 date 24 February 2004 entitled “Amendments to EMA-MC-01366 dated 09 October 2001 Re: “Revised Guidelines on Conversion of Foreign Driver’s Into Philippine Driver’s License” provides the following requirements and procedure, to wit:

1.     Original and 1 (one) photocopy of valid foreign license. If the foreign driver’s license in not in English Language, the applicant should submit an official English translation from the local Embassy of the issuing Country;

2.     Original and machine copy of a valid passport showing the latest date of arrival in the Philippines of the foreign applicant;

3.     Original and machine copy of valid visa or Alien Certificate of Registration (ACR) if the foreign applicant temporarily resides in the Philippines;

4.     Original copy of Medical Certificate issued by an LTO accredited or government physician;

5.     Original copy of drug test result issued by DOH Accredited Drug Testing Center;

6.     If, foreign license is expired, applicant shall undergo written and practical examinations;

Valid or not, if a foreign driver’s license is converted into Professional driver’s license, an applicant is required to undergo a written and practical examinations. An applicant must present proof as to why there is a need to secure a Professional driver’s license, such as:


1.     Venue: If an applicant is hired as a company employee, the following documents must be presented:

        (a) Original copy of Police / NBI / Court Clearance issued from the area of residence;

        (b) Original and machine copy of Certificate of Employment from local employer or foreign employer in the Philippines;

        (c) Original and machine copy valid working visa issued by the Bureau of Immigration or valid working permit issued by the Department of labor and Employment.

2.     Venue: If the applicant operates his or her own business, the following documents must be presented:

        (a) Original copy of Police / NBI / Court Clearance issued from the area of residence;

        (b) Original and machine copy of Investment Permit duly issued by the Department of Trade and Industry (DTI) or Security and Exchange Commission (SEC) if the foreign applicant operates his own business;

        (c) Original and machine copy of certificate of registration and current official receipt of payment if there is a need to operate a motor vehicle classified as “Heavy”. The said vehicle must be the one used as the test drive vehicle during the actual examination and therefore shall determine the appropriate restriction thereof;
